Probation and parole Violations

A Violation Allegation Can Move Fast. So Should Your Defense.

Serving clients in East Lansing, Lansing, Flint, Jackson, Charlotte—plus surrounding Mid‑Michigan communities.

Probation and parole violation allegations can put your freedom at risk and often come with short timelines. I’m Tara Nichol, a trial-focused defense attorney based in East Lansing. I help clients understand what they’re accused of, what evidence matters, and what options may be available before the hearing. If you have a violation notice or a hearing date, let’s get a plan in place .

When this comes up

  • You received a notice of violation or a request to appear in court
  • Your probation officer says you violated a condition (missed test, missed appointment, new allegation, etc.)
  • You’re worried about a warrant, a hold, or being taken into custody at the hearing
  • You tested positive or were accused of tampering/avoiding testing
  • There’s confusion about what the conditions require or what counts as a violation

What I do (hearing-focused approach)

  • Review the alleged violation(s), conditions, and timeline so we know what’s actually at issue
  • Identify what evidence exists (reports, test results, messages, attendance logs, witnesses) and what’s missing
  • Prepare you for the hearing: what to expect, what to say (and not say), and how to present your side clearly
  • Develop a strategy for minimizing consequences, including treatment/compliance plans when appropriate
  • Make sure your court dates and requirements are clear so you don’t get hit with avoidable problems

What to bring / what I need from you

  • Your probation/parole order and any written conditions
  • The violation notice, hearing notice, or any warrant paperwork (if you have it)
  • Any texts/emails with your PO, appointment logs, testing receipts, or proof of compliance
  • Treatment/AA/NA documentation (if relevant)
  • A clear timeline of what happened and when
  • Any pending/new charges paperwork (if applicable)

Your Top Questions (FAQ)

Q: What should I do as soon as I find out there’s an alleged violation?

A: Don’t ignore it and don’t assume it will “work itself out.” Gather your paperwork, write down the timeline, and make sure you know your next court date. If you have proof of compliance (testing, treatment, work schedule, messages), save it. Getting advice early helps you avoid missteps and prepare for the hearing.

Q: Will I be kicked off probation (or sent to jail) for a violation?

A: It depends on what’s alleged, your history, and the court’s expectations. Some violations are handled with added conditions, treatment, or a warning, while others can lead to custody or a more serious consequence. In a consult, we’ll talk through the specific allegation, the likely risks, and how to show up prepared.

Q: What’s the difference between a technical violation and a non-technical violation?

A: A technical violation is usually about compliance with conditions (missed test, missed appointment, curfew, travel restrictions, fees, treatment requirements). A non-technical violation typically involves a new alleged offense or more serious conduct. The difference matters because it can affect how the court views the allegation, what evidence is involved, and what outcomes are on the table
